A new fair judicial decision for depositors

The Head of the Beirut Execution Department, Judge Mariana Anani, issued a new decision which is considered fair for depositors.

The decision indicated that “returning deposits to depositors by bank checks does not absolve the bank, because this scheme will not give depositors at the present time the actual fulfillment. The bank in its relationship with the depositor, bears the responsibility for breaching its contractual obligations, if directly related to the implementation of the banking operation required, such as making bank transfers, or with regard to the professional obligations imposed on banks not to violate the integrity of the credit. The bank should secure the necessary liquidity for the provision of checks, to preserve the rights of depositors and their money, and the need to return the deposit to its owners in a way that achieves actual fulfillment for them and does not cause them any damage or lead to depriving them of actually obtaining or using their money and invested productively.”
